Terms and Conditions of the Digital Presence Audit
Version 1 · 01/10/2026. This version is being updated; for any question, write to dd@doingdigital.me. This is an English translation for convenience; the Portuguese version prevails.
1. Who we are
Doing Digital Agência de Marketing Digital, trading as doing digital, with its address at R. Malhões, 2770-071 Paço de Arcos, telephone +351 920 224 927, email address dd@doingdigital.me.
Our registration details (legal form, tax identification number and entry in the commercial register) are being updated on this page and always appear on the written proposal and on the invoice. In the meantime, we will send them in writing to anyone who asks at dd@doingdigital.me.
Throughout these terms, «we» means that entity and «doing digital» is the name under which we trade. «You» means whoever commissions the audit.
2. What these terms govern, and when the contract is formed
They govern the purchase of the digital presence audit. They do not govern our monthly support services, which are contracted under a separate proposal and on their own conditions.
Requesting the audit, by email or by WhatsApp, does not create any contract. It is a request to be contacted: you pay nothing and commit to nothing. We then talk, and only afterwards, if we both wish to go ahead, is there a contract.
The contract is deemed concluded at the moment we confirm receipt of payment. That is the date that counts for everything that follows in these terms, including the time limits in section 8. Before you pay, we send you these terms in writing, with the price, the payment methods and the delivery period and, if you are a consumer, the information on the right of withdrawal and the corresponding form. Once we have confirmed payment, and always before we start work, we send you by email the confirmation of the contract with these terms in the version then in force and, if you are a consumer and have asked us to begin before the withdrawal period ends, the record of that request.
3. What the audit is
We analyse three things and deliver two.
We analyse your website: what is on it, what no longer matches what you do and what holds it back technically. We analyse your visibility, in search engines and in the answers that artificial intelligence systems give about your sector. And we analyse your direct competitors: what they do, how often and where they appear ahead of you.
We deliver a document, with each finding and the evidence alongside it, and a plan in order of priority. And we deliver a conversation about that document, because a document on its own decides nothing.
4. What the audit is not
It is not a forecast of results. We do not promise rankings, traffic, enquiries or sales. Visibility is measured in months and depends on factors we do not control, starting with third-party algorithms and whatever your competitors do. Anyone who promises you otherwise is selling something else.
It is not a plan to carry out on your own. It says what we found and in what order to deal with it. It is not a list of tasks to do at home.
It is not a legal, accounting or IT security audit. If we find something that looks to us like a problem in one of those areas, we will say so, but as someone flagging it, not as someone giving an opinion on it.
5. Price and payment
390 € plus VAT at the applicable legal rate, totalling 479,70 € at the 23% rate. Payment in full and in advance.
The accepted payment methods are set out in the written proposal we send you before any payment. The invoice is issued in the name of the entity identified in section 1.
The service only begins once payment has been confirmed.
6. How it works, and how long it takes
- You request the audit by email, at dd@doingdigital.me, or by WhatsApp, at +351 920 224 927.
- We talk for about thirty minutes. This lets us understand your business and tell you, frankly, whether the audit is right for you. If it is not, we say so and do not go ahead. This conversation is free of charge and commits you to nothing.
- Once confirmed and paid, we deliver within 10 working days from the start of work. Delivery comprises the document and the conversation about it.
- When work begins. For clients contracting in the course of their professional activity, work begins on the working day following confirmation of payment. For consumers, it begins at that same moment if they have expressly requested it under section 8.2; if they do not request it, it begins once the 14-day withdrawal period has ended, which is the natural effect of that right and not a delay on our part.
- If we need access from you to see what we have to see, and you do not provide it, the time limit is suspended while we wait.
The 10-working-day period is a commitment, not an estimate. If for any reason we cannot meet it, we will tell you before it ends and not afterwards, and in that case you may terminate the contract and receive a full refund.
7. The credit towards monthly support
If you contract a monthly support service within 30 days of delivery of the audit, the amount paid for the audit is credited up to the value of one month of that service.
Three points of detail, so that there is no doubt later:
- The credit is up to the value of one month. If the support service you contract costs less than the audit, the remainder is neither refunded nor carried over to the following months.
- It applies once, to the first month.
- After the 30 days, it no longer applies.
8. Cancellation and refunds
This section has two parts, because the law treats those who buy for their professional activity differently from those who buy outside it.
8.1. If you contract in the course of your professional activity
This is the case for most of our clients: companies, sole traders and self-employed professionals who commission the audit for their business.
The right of withdrawal regime of Decreto-Lei n.º 24/2014, which the law reserves for consumers, does not apply here. The following applies instead, as established by contract:
- Before we start work, you may cancel and we refund the full amount.
- After we have started and before delivery, we refund the proportion corresponding to the work not yet done.
- After delivery of the document, there is no refund, because the service has been provided.
If you feel that what we delivered does not match what is described in section 3, tell us, and we are very keen to put it right. We have no interest in selling an audit that is of no use to anyone.
8.2. If you contract as a consumer
Under article 3, point e) of Decreto-Lei n.º 24/2014, a consumer is a natural person acting for purposes outside their commercial, industrial, craft or professional activity.
If that is your case, you have 14 days to withdraw from the contract freely, without giving any reason and at no cost, counted from the day the contract is concluded(article 10, paragraph 1, point a) of the same decree-law).
To exercise this right, simply notify us of your decision, at dd@doingdigital.me, by any unequivocal means. You may use the withdrawal form in the annex to these terms, but you are not obliged to. We refund within 14 days of receiving your notice, using the same means of payment you used.
If you want us to start before those 14 days have passed, which is normal when someone is in a hurry, we need your express request to that effect. In that case:
- If you withdraw from the contract after work has begun, you pay the proportion of what has actually been provided up to the moment you notify us of your withdrawal, calculated on the total price (article 15, paragraphs 2 and 3).
- If, at the date of withdrawal, the audit has already been fully provided, and you gave your prior express consent and acknowledged that you would lose the right of withdrawal in that case, you can no longer withdraw freely(article 17, paragraph 1, point a)).
For this purpose, the audit is deemed fully provided when we have delivered the document to you and held the conversation about it.
These two conditions are not hidden small print: they are presented to you, for express and separate acceptance, at the moment you contract, with the following declaration, which you confirm in writing in a reply of its own, separate from your acceptance of these terms:
«I expressly request that doing digital begin providing the audit service before the 14-day withdrawal period ends. I understand that, if I withdraw from the contract after work has begun, I will pay an amount proportionate to what has been provided up to the moment I notify the withdrawal. I acknowledge that, if the audit is fully provided, I will lose the right of withdrawal.»
9. Your obligations
To carry out the audit we need to see what there is to see. You undertake to give us, in good time, the access and information needed, and to ensure that this information is true.
We are not responsible for wrong conclusions resulting from wrong information you have given us.
10. Confidentiality
What we see of your business stays with us. We do not disclose it to third parties or use it for any purpose other than providing the service, unless required by law. We only name you as a client if you authorise us in writing, case by case.
11. Ownership of what we deliver
The audit document is yours, and you may use it as you see fit within your organisation, including to carry out the plan with another supplier.
What remains ours are the methods, templates and tools with which we produce it.
12. Liability
We are liable for the damage we cause through breach of these terms, in accordance with the general provisions of the law.
We are not liable for decisions you take on the basis of the audit, nor for the results of those decisions. The audit informs the decision. The decision is yours.
13. Who signs
The audit is checked and signed by Ricardo Lourenço, who answers for what the document says and is the person who talks to you.
14. Complaints and dispute resolution
If you have a complaint, write to dd@doingdigital.me. We reply in writing. You may also use the Livro de Reclamações Eletrónico (the official Portuguese electronic complaints book), at www.livroreclamacoes.pt.
Alternative dispute resolution, for consumers. If you are a consumer and we have a dispute that we cannot resolve between ourselves, you may turn to a consumer alternative dispute resolution entity. In consumer disputes of a value not exceeding 5 000 €, which is the jurisdictional limit of the courts of first instance (article 44, paragraph 1, of Lei n.º 62/2013), arbitration is mandatory when the consumer, by express choice, requests it (article 14, paragraphs 2 and 3, of Lei n.º 24/96). By virtue of that rule, we are bound by the legally authorised consumer dispute arbitration centres, which are:
- Centro de Arbitragem de Conflitos de Consumo de Lisboa (CACCL), municipalities of the Lisbon Metropolitan Area: www.centroarbitragemlisboa.pt
- Centro de Informação de Consumo e Arbitragem do Porto (CICAP), municipalities of the Porto Metropolitan Area: www.cicap.pt
- Centro de Arbitragem de Conflitos de Consumo do Vale do Ave/Tribunal Arbitral (TRIAVE): www.triave.pt
- Centro de Informação, Mediação e Arbitragem de Consumo/Tribunal Arbitral (CIAB): www.ciab.pt
- Centro de Arbitragem de Conflitos de Consumo do Distrito de Coimbra: www.centrodearbitragemdecoimbra.com
- Centro de Informação, Mediação e Arbitragem de Conflitos de Consumo do Algarve (CIMAAL), district of Faro: www.consumidoronline.pt
- Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (CNIACC), with national and residual jurisdiction, for areas not covered by the centres above: www.cniacc.pt
As this contract is concluded at a distance, the competent centre is, as a rule, the one for the area where you live. If you live in the Lisbon Metropolitan Area, it is the CACCL. The official list is published by the Direção-Geral do Consumidor (the Portuguese Directorate-General for Consumers), at www.consumidor.gov.pt.
This route is open to consumers against us. The law excludes from it disputes brought by traders against consumers (article 2, paragraph 2, point d), of Lei n.º 144/2015), and it does not, in principle, apply to clients contracting in the course of their professional activity.
15. Applicable law and jurisdiction
Portuguese law applies. If you are a consumer, this choice does not deprive you of the protection afforded to you by the mandatory provisions of the law of the country where you habitually reside, where that law is applicable, and disputes are decided by the competent court in accordance with the general provisions of the law, without prejudice to the arbitration provided for in section 14. If you contract in the course of your professional activity, the court of the district of our registered office has jurisdiction.
16. Changes to these terms
We may change these terms. The version applicable to your contract is the one in force on the day you contracted, and that is the one we give you in writing at the time of contracting.
Annex. Withdrawal form
